The Role of the Sports Administrative Court of Spain in the Sports Judicial Process
Keywords:
Sports Administrative Court of Spain, Sports Judicial Process, SpainAbstract
The paper includes appropriate coverage of the role of the Sports Administrative Court of Spain as it relates to sports judicial proceedings in Spain, as well as offering resolutions of sports disciplinary disputes and electoral issues in sports governance and resolutions of anti-doping disputes between athletes and sporting governing entities. It shows how the growth of autonomous governing power of Spanish sports and central government's intervention in the recognition of official dispute resolution process for sports in the 21st century onward inspired a multitude of Spanish governmental supports struggling to shape the sports judicial process in Spain. It also places role of the Sports Administrative Court of Spain in context of fairness and integrity protection, through detailed coverage of The Spanish Sports Law (Law 39/2022), and coverage of the sporting governing rules and regulations in the Spanish sports administrative system, alongside references to core jurisdiction and functions of the Sports Administrative Court of Spain for ensuring regulatory compliance with the Spanish sports law. Problems resulting from the judicial practice of the Sports Administrative Court of Spain related to controversies of judicial independence are also discussed.
